“But isn’t it going to start a Trade War?”

That seems to be the most common argument used against filing a Section 301(a) petition.  Well?  Will it?

The Law Offices of Stewart and Stewart is a Washington D.C.-based law firm that focuses primarily on trade issues as determined under U.S. law and international agreements.

Since they are the experts, we went to Stewart and Stewart and spoke with two of their lead attorneys to ask, among other things.... Will it start a trade war?  Here’s what they told us.

(The videos below require Macromedia Flash Player.)

ALAN M. DUNN
Former Assistant Secretary of Commerce, Lead U.S. Negotiator on subsidies and anti-dumping rules for NAFTA and GATT Uruguay Road negotiations.

WILLIAM A. FENNELL
International trade attorney, has represented clients before the U.S. Department of Commerce, U.S. International Trade Commission, U.S. Customs Service and the Office of the United States Trade Representative.

startinyAn Interview with FTAC’s attorneys... introducing Alan Dunn and Bill Fennel.

startinyWhy do the Stewart and Stewart attorneys recommend a 301(a) petition to address Runaway Production?

startinyExactly what is a 301(a) petition?

startinyThe MPAA has often argued against a 301(a) petition because they say a 301(a) is a bad thing to do.  But hasn’t the MPAA already used the 301(a) as a means to protect their own profits?

startinyWill filing a 301(a) endanger domestic film subsidies?

startinyOnce it is granted, how long will it take for a 301(a) petition to go into effect?

startinyWill filing a 301(a) cause a Trade War?

startinyYou’re trying to tackle this on the Federal level, but wouldn’t you have a stronger case if you could show that individual communities are deeply effected by the problem of Runaway Production?
